EECA 2024 has applied since 1 January 2025, and Suruhanjaya Tenaga can designate your company as a designated consumer by written notice at any time. The compliance clock

Once Suruhanjaya Tenaga's written notice under s.3(3) arrives, the deadlines cascade — and the EnMS deadline is anchored to your REM appointment, not the notice:

  1. Appoint a registered energy manager (REM)
    reg 4(2), P.U.(A) 466/2024 · penalty up to RM50,000 (s.5(3))
    Notice + 3 months
  2. Develop the EnMS in accordance with GP/ST/No.46/2024
    reg 8; s.6 Act 861 · penalties up to RM50,000 (s.6(3)) / RM20,000 (s.6(4))
    REM appointment + 1 year
  3. Submit the first EE&C report — which must describe that EnMS
    reg 9(a); s.7 Act 861 · penalty up to RM50,000 (s.7(4))
    REM appointment + 1 year + 30 days
  4. Submit the first energy audit report (parallel track)
    reg 10(1)(a); ss.8–9 Act 861
    Notice + 1 year
The catch: the first EE&C report lands in the same month the EnMS falls due — and the report must describe the EnMS (s.7(1)(a)). Leave the system to month eleven and there is nothing to describe. Committee, policy, data and baseline need to exist by roughly month six.
